Welcome to ABQ Sound Lab. By accessing or using https://ABQSoundLab.com, purchasing beats or instrumentals, or booking recording studio services, you agree to the following Terms & Conditions.
These terms apply to all website visitors, customers, recording artists, bands, producers, and clients using services provided by ABQ Sound Lab and Provoke Beats.
1. General Terms
By accessing this website, you agree to comply with these Terms & Conditions and all applicable local, state, and federal laws.
If you disagree with these terms, you should discontinue use of the website and its services.
All website content, including text, graphics, logos, audio demonstrations, images, and original materials, is protected by applicable copyright and intellectual property laws.
2. Recording Studio Services
ABQ Sound Lab provides professional audio recording, music production, mixing, mastering, and related studio services.
Services may include:
- Live band recording sessions
- Individual instrument and vocal recording
- Music production and audio editing
- Mixing and mastering
- Remote mixing and mastering
- Additional recording time and related services
Services are provided according to the selected booking package and any written agreements made between ABQ Sound Lab and the client.
Session Duration
Recording sessions are scheduled for the duration selected during booking.
Our standard live band recording packages include:
- 2-Hour Recording Session — $250: Typically accommodates up to 2–3 songs.
- 4-Hour Recording Session — $400: Typically accommodates up to 5 songs.
- Additional Studio Time — $60 per hour, subject to availability.
Song quantities are estimates and are not guaranteed. Actual recording output depends on preparation, song length, complexity, performance quality, setup, and the number of takes required.
Session time includes equipment setup, soundchecks, instrument adjustments, recording, breaks, and retakes.
Late arrivals do not automatically extend the scheduled session.
3. Recording Session Bookings, Deposits & Payments
All recording sessions must be scheduled through our online booking system or arranged directly with ABQ Sound Lab.
A non-refundable deposit is required to secure a recording session. The deposit amount will be displayed during booking and applied toward the total cost of the selected recording package.
By submitting a deposit, the client acknowledges and agrees to the following:
- All recording session deposits are non-refundable, except where required by law or expressly stated in these terms.
- Deposits reserve a specific date and time and compensate ABQ Sound Lab for holding that availability.
- Deposits are credited toward the total recording session price and are not an additional charge.
- Any remaining balance must be paid according to the payment terms disclosed during booking.
- A recording session is confirmed only after the required deposit has been received and booking confirmation has been issued.
If ABQ Sound Lab cancels a session and cannot provide an alternative date acceptable to the client, the deposit and any other payments collected for the undelivered session will be refunded.
4. Cancellations, Rescheduling & No-Shows
Clients are responsible for attending their scheduled recording sessions and providing advance notice of any cancellations or rescheduling requests.
Cancellations
All client-initiated cancellations will result in forfeiture of the non-refundable booking deposit, subject to applicable law.
This applies regardless of how far in advance the cancellation is requested, unless ABQ Sound Lab agrees otherwise in writing.
Rescheduling
Clients may request to reschedule their recording session by contacting ABQ Sound Lab in advance.
Rescheduling is subject to studio availability and approval.
ABQ Sound Lab may, at its discretion, transfer an existing deposit to an approved rescheduled date. Deposit transfers are not guaranteed.
No-Shows & Late Arrivals
Clients who fail to attend their scheduled recording session without notice will forfeit their non-refundable deposit.
Late arrivals do not extend the scheduled recording session. The session will end at its originally scheduled time unless additional studio time is available and purchased.
Studio-Initiated Cancellations
If ABQ Sound Lab must cancel a confirmed session due to an emergency, equipment failure, illness, or another studio-related issue, the client will be offered an alternative recording date.
If the client declines the alternative date, all payments collected for the canceled session, including the deposit, will be refunded.
5. Studio Equipment & Client Responsibilities
ABQ Sound Lab provides access to designated studio equipment, which may include microphones, amplifiers, speaker cabinets, drum equipment, recording hardware, and other available instruments.
Clients are expected to treat all studio equipment and facilities with reasonable care.
Clients may bring their own instruments, amplifiers, cymbals, snare drums, pedals, and other personal equipment.
Clients must notify ABQ Sound Lab in advance of any special equipment or recording requirements.
Clients may be responsible for the reasonable repair or replacement cost of studio equipment damaged through negligence, misuse, or intentional conduct, excluding normal wear and tear.
ABQ Sound Lab is not responsible for loss or damage to personal equipment except to the extent caused by its negligence or otherwise required by law.
6. Mixing, Mastering & Audio Deliverables
Mixing and mastering are currently included at no additional charge with eligible live band recording packages unless otherwise stated at the time of booking.
Included services may consist of audio editing, cleanup, equalization, compression, effects processing, mixing, and mastering.
The scope of included work will be based on the selected package and the reasonable requirements of the recording project.
Additional revisions, extensive editing, production changes, or services outside the agreed scope may require additional fees, subject to client approval.
Final audio delivery formats and estimated completion times will be communicated during or following the session.
Clients may request available multitrack recordings or stems for use with an outside mixing or mastering engineer.
Any separately quoted services or additional file preparation fees will be disclosed before work begins.
7. Recording Ownership & Copyright
Unless otherwise agreed in writing, clients retain ownership of their original songs, lyrics, compositions, and performances.
Upon full payment of all agreed recording and production fees, clients retain the rights to use and distribute their completed recordings, subject to any third-party rights, samples, licenses, or separately agreed production arrangements.
ABQ Sound Lab does not claim ownership of a client’s original compositions merely because they were recorded at the studio.
Clients are responsible for obtaining permission to record, reproduce, distribute, or commercially exploit any copyrighted material they do not own.
ABQ Sound Lab retains ownership of its pre-existing production tools, templates, presets, original website materials, and other intellectual property not specifically transferred through a written agreement.
8. Studio Portfolio & Promotional Use
ABQ Sound Lab may request permission to feature completed recordings, photographs, videos, artist names, or testimonials on its website, social media, and promotional materials.
ABQ Sound Lab will not publicly release or use a client’s unreleased recordings for promotional purposes without the client’s permission.
Any promotional use will be subject to the permissions granted by the client and applicable copyright requirements.
9. Recording Files & Data Storage
ABQ Sound Lab may retain session files, project files, multitrack recordings, and completed mixes for operational or archival purposes.
However, permanent storage or indefinite availability of these files is not guaranteed unless separately agreed in writing.
Clients are encouraged to download and maintain their own backups of delivered recordings.
ABQ Sound Lab will take reasonable precautions to protect recorded materials but cannot guarantee against every form of hardware failure, corruption, or accidental data loss.
If a technical failure materially prevents delivery of paid services, ABQ Sound Lab will work with the client toward an appropriate remedy, subject to applicable law.
10. Beats & Instrumental Licensing
ABQ Sound Lab offers beats and instrumentals through its collaboration with Provoke Beats.
Purchasing a beat does not automatically transfer copyright ownership of the underlying instrumental.
The rights granted to a purchaser depend on the specific license selected at checkout.
The complete license terms are included in the download packet provided with the purchase.
Clients must review and comply with the applicable license agreement, including any restrictions involving commercial use, distribution, streaming, sales, performances, and permitted reproductions.
Where a beat license conflicts with the general website terms regarding permitted use of the purchased beat, the specific beat license controls.
11. Content ID Restrictions
Non-exclusive beat licenses do not authorize registration of the instrumental or resulting song with automated Content ID or similar copyright-claiming systems.
An exclusive license must be purchased before using the instrumental in a Content ID system, and such use remains subject to the terms of the exclusive license.
Unauthorized Content ID registration, automated copyright claims, or attempts to claim exclusive ownership of a non-exclusively licensed instrumental are prohibited.
Violations may result in license termination and other remedies permitted by the applicable license agreement and law.
12. Prohibited Redistribution & Resale
Unless expressly authorized by the applicable license agreement, customers may not:
- Resell, sublicense, lease, or redistribute instrumental files in their original form.
- Share purchased source files through file-sharing websites, forums, or public download platforms.
- Claim authorship or ownership of an instrumental created by Provoke Beats.
- Sell or distribute purchased instrumentals as standalone competing beat products.
- Transfer licensed rights to another person without authorization.
These restrictions do not prohibit authorized distribution of original songs created using properly licensed instrumentals within the scope of the purchased license.
13. Payment & License Validity
Full payment must be completed before purchased beat files or other prepaid digital products are delivered.
If a payment is reversed, charged back, or otherwise invalidated, the associated license may be suspended or terminated in accordance with its terms and applicable law.
Upon valid termination, the purchaser must discontinue uses no longer authorized under the license.
Provoke Beats retains the right to license or sell non-exclusive instrumentals to other customers, subject to any applicable exclusive licensing agreement.
14. Digital Products & Refunds
Because digital beat files and downloadable products may be delivered immediately after purchase, refunds may be limited once the files have been delivered or accessed, except where required by law or expressly permitted by the applicable purchase terms.
Refunds for recording studio services are governed by the booking and cancellation terms disclosed at the time of purchase.
Nothing in these Terms & Conditions limits any non-waivable consumer rights or remedies provided by applicable law.
15. Website Use License
Permission is granted to temporarily access and view website materials for personal, lawful use.
Without prior written authorization, users may not:
- Copy or commercially redistribute protected website materials.
- Remove copyright notices or proprietary markings.
- Reverse engineer software or protected systems where prohibited by law.
- Mirror or reproduce substantial portions of the website on another server.
- Use website content to create competing products or services in violation of applicable intellectual property rights.
This website viewing license does not override the rights expressly granted through a purchased beat license or recording services agreement.
16. Disclaimer
Website content is provided on an “as available” basis.
ABQ Sound Lab makes reasonable efforts to provide accurate service descriptions, prices, scheduling information, and website materials.
However, information may occasionally contain errors or require updates.
To the extent permitted by law, ABQ Sound Lab disclaims warranties not expressly provided in a written service agreement.
Nothing in this section excludes warranties or consumer protections that cannot legally be waived.
17. Limitation of Liability
To the maximum extent permitted by applicable law, ABQ Sound Lab and Provoke Beats will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or services.
These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be limited, including liability arising from certain forms of negligence or misconduct.
18. Third-Party Websites & Services
This website may contain links to external websites, streaming platforms, payment processors, booking providers, or other third-party services.
ABQ Sound Lab is not responsible for the content, security, or policies of third-party websites outside its control.
Users should review the terms and privacy policies of third-party services before using them.
19. Privacy
Use of this website is also subject to our Privacy Policy.
Information submitted through booking forms, contact forms, and payment systems will be handled in accordance with the applicable Privacy Policy.
20. Changes to Terms & Conditions
ABQ Sound Lab reserves the right to update these Terms & Conditions as necessary.
Updated terms will be published on this website with a revised effective date.
Changes will apply prospectively and will not retroactively alter an existing paid booking or executed license agreement without an applicable contractual or legal basis.
21. Governing Law
These Terms & Conditions are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
